Lex Lumina Obtains Rare Federal Circuit En Banc Review in Design Patent Case

June 30, 2023 - Lex Lumina’s Mark Lemley and Mark McKenna, along with lawyers from Irwin IP LLP, today secured exceedingly rare en banc review by the full U.S. Court of Appeals for the Federal Circuit on behalf of LKQ Corp. in LKQ Corp. v. GM Global Tech. Ops. LLC, Fed Cir., 21-2348. The full Court has agreed to hear an appeal from LKQ that asks the Court to reconsider its test for whether a design patent is obvious.
